HostingTom Acceptable Usage Policy (AUP)

Introduction

As a provider of web hosting and Internet-related services, HostingTom (“Hostingtom”, “we”, “our”, or “us”) offers customers the ability to publish, access, and share information online.

We support the free exchange of information and open communication on the Internet. However, to protect our customers, infrastructure, reputation, and the broader Internet community, all users of HostingTom services must comply with this Acceptable Usage Policy (AUP).

This AUP supplements our Terms of Service and may be updated from time to time without prior notice.


Customer Responsibility

The Internet is an open platform that is not owned or controlled by any single organization. As a result, users are responsible for the content they access, publish, transmit, and store.

HostingTom does not monitor, verify, or guarantee the accuracy, legality, or quality of information available on the Internet. Users should exercise caution and judgment when relying on online content.

Similarly, customers are solely responsible for any content they publish using HostingTom services and may be held liable for violations of applicable laws, copyrights, trademarks, privacy rights, or other legal obligations.


Prohibited Activities

The following activities are strictly prohibited on HostingTom services.

1. Spam and Unsolicited Communications

You may not:

  • Send unsolicited bulk emails (spam)
  • Operate open SMTP relays
  • Conduct mass commercial email campaigns without consent
  • Use HostingTom services for email abuse

Accounts involved in spam activities may be suspended or terminated immediately.

HostingTom reserves the right to assess penalties and pursue legal remedies where applicable.


2. Adult Content

Customers intending to host adult-oriented content, including:

  • Images
  • Videos
  • Games
  • Audio
  • Software

must notify HostingTom before or during account signup.

Failure to disclose such content may result in suspension or termination of services.


3. Child Exploitation and Obscene Content

The following content is strictly prohibited:

  • Child sexual abuse material (CSAM)
  • Child pornography
  • Obscene or illegal content

HostingTom will immediately report such content to law enforcement authorities as required by law.


4. Harassment, Defamation, and Abuse

You may not use HostingTom services to:

  • Harass individuals or organizations
  • Publish defamatory content
  • Transmit abusive or threatening communications
  • Engage in cyberbullying or intimidation

5. Email and Header Forgery

Customers may not:

  • Forge email headers
  • Falsify sender information
  • Misrepresent message origins
  • Conceal the source of communications for deceptive purposes

6. Unauthorized Access and Hacking

You may not:

  • Access systems without authorization
  • Attempt to bypass security controls
  • Conduct port scanning
  • Perform vulnerability probing
  • Engage in hacking activities

Activities intended to gather information for unauthorized access are also prohibited.


7. Malware and Network Abuse

HostingTom services may not be used to:

  • Distribute viruses
  • Spread worms or trojans
  • Launch denial-of-service (DDoS) attacks
  • Conduct flooding or mail-bombing attacks
  • Disrupt networks, systems, or services

8. Facilitating Violations

You may not advertise, distribute, or provide software, services, or tools designed to:

  • Send spam
  • Launch attacks
  • Bypass security systems
  • Facilitate hacking
  • Enable software piracy

9. Export Control Violations

Customers must comply with all applicable export control laws and regulations when transmitting software, technical information, or related materials.


10. Copyright and Intellectual Property Infringement

You may not host, distribute, or use content that violates:

  • Copyrights
  • Trademarks
  • Patents
  • Personality rights
  • Other intellectual property rights

HostingTom will respond to valid infringement complaints and may remove violating content.


11. VPN Services

VPN services may not be operated in jurisdictions or datacenters where such services are prohibited by law or restricted by the facility provider.

Customers are responsible for ensuring compliance with local regulations.


12. Fraudulent and Illegal Activities

HostingTom services may not be used for:

  • Ponzi schemes
  • Pyramid schemes
  • Credit card fraud
  • Identity theft
  • Software piracy
  • Financial scams
  • Any illegal activity

13. Activities Harmful to HostingTom

HostingTom reserves the right to restrict or terminate any activity that negatively impacts:

  • Customers
  • Network stability
  • Service availability
  • Company reputation
  • Business operations

even if the activity is not explicitly listed in this policy.


Enforcement

HostingTom does not routinely monitor customer communications or content.

However, when violations are identified, we may take one or more of the following actions:

  • Remove offending content
  • Suspend services
  • Terminate accounts
  • Restrict network access
  • Report violations to authorities
  • Take legal action where appropriate

Reseller Responsibility

Customers who provide hosting or Internet services to third parties remain responsible for ensuring their users comply with this AUP.

HostingTom reserves the right to take direct action against end users or reseller accounts involved in violations.

Failure to cooperate with abuse investigations may itself constitute a violation of this policy.


Privacy and Disclosure

HostingTom respects customer privacy and does not intentionally monitor private communications except when:

  • Required by law
  • Requested by a government authority
  • Necessary to protect public safety
  • Required to maintain network integrity

HostingTom may disclose customer information when legally obligated to do so or when necessary to protect HostingTom, its customers, or the public.

HostingTom does not sell customer information to third parties.


Indemnification

Customers agree to indemnify and hold HostingTom harmless from claims, damages, losses, liabilities, legal costs, and attorney fees arising from violations of:

  • This Acceptable Usage Policy
  • Applicable laws
  • HostingTom Terms of Service

Policy Updates

HostingTom reserves the right to modify this Acceptable Usage Policy at any time. Continued use of our services after changes are posted constitutes acceptance of the updated policy.
